In the organisation I have recently joined we have the following situation:
An employee is currently on maternity leave and the person who came in as maternity cover has effectively been promoted to a new permanent position senior to that of the original employee. The original employee has not been informed of this or involved in any way. The Directors say that if she had applied she would not have been offered the position so it was easier not to tell her. I believe she has a case for sex discrimination, but the important thing now is damage limitation. Any suggestions?
