The company I work for are undergoing a period of administration. As a result, I have not been paid for the first week of March and have not had my bonus (which I worked hard for) or my expenses for February. I will only receive 9 days pay for March.
I had been looking to leave anyway and had several offers, susequently handing my notice in on Friday. I wrote a very polite letter requesting that they release me of my duties early, as this will give me the opportunity to start earning a regular secure income, which they have obviously been unable to do. This means I gave them 2 weeks notice instead of the 4 weeks that is outlined in my T&C’s. I explained that I will waiver any rights I have to be paid for the two weeks that I will not be working for.
I have been told that this is not acceptable and they want the full 4 weeks. I am not a senior member of staff and there will be no major significant impact anyway, as 70% of my clients left us when the news about the company was made public.
I have put forward a case for how my handover will be more than sufficient and that I will work in the evenings over the next two weeks to ensure everything is finalised. They are still insisting on the 4 weeks. – have they not broken the contract they have with me as they have not paid me for monies in feb and the wages for the 1st week of March (before the company went into administartion)?
