If the contract of employment states that an employee must work one months notice plus a week for every year completed over 4 years, meaning that this person will have to give 7 weeks notice, does he have to abide by this? His company has just been taken over due to the previous employer going into Administration, he is not happy with the new employer and during this unsettled time he attended an interview and has just been offered the position, this extended notice period coul put this offer in jeopardy. Does he have to work the 7 weeks notice, can he offer to work one months notice or less? There are 2 other employees who could carry out his role so as not leaving the employer in an awkward situation. What is the shortest amount of notice he can provide?

I would be grateful of any advice anyone can offer.

thank you
