We made an employee redundant about 2 months ago (came bottom of the selection criteria due mainly to existing warnings for poor attendance).

One of the remaining team has just handed thier notice in so we have advertised for a replacement. The employee whom we made redundant has asked for their job back.

Do we have to take them back or can they be considered along with all other applicants?
If we do have to re-employ do they have to repay any of their redundancy?
