One of our employees has resigned.
Their notice period is 2 mths, but within the resignation letter they asked to go after just under a month.
This has been agreed.
However now the employee has asked to be paid for the full 2 months notice period even though they are leaving earlier than usual.
Their argument is that they have resigned, and that automatically kicks the 2 mth notice period into effect from point of resignation.
The fact they are leaving early is by separate negotiation and they haven’t signed away their rights to the 2mth notice period pay.
Is this correct?
