We have an employee who had alot of time off through preganancy related illess up to her maternity leave and returned to work earlier than her six months OML entitlement. Five months later she was signed off with post natal depression by her GP but asked her GP to sign her off because under the Company’s sick pay entitlement her pay was reduced to half, because it included her pregnancy related absence. As the company pays enhanced sick pay are we okay to do this as she thinks she has suffered a detriment due to her pregnancy?
