An employee is working their 3 months notice period after being made redundant. The company is part of a Group which now has a position similar to that of the employee being made redundant (with a different title) could we offer this position to the person being made redundant or are we too late? If we do, legally we would need to offer a 4 week trial period and if it didn’t work out for either party would their original redundancy leave date be extended by four weeks?
