We employ flexi staff who we know work elsewhwere. Some of them have full time jobs already of 37 hours per week & do addtional hours with us.
ACAS interpretation of the regs is that each employer is only responsible for the employees hours with them. ie as long as we don’t exceed the 48 hours rule, we need not worry about what is going on elsewehre. This was not my understanding. Can anyone shed any light? Surely if we give work to smeone who has already worked 50 hours elsewhere, is tired, has an accident, somone is liable or reponsible to ensure this scenario is avoided if possible?
I tried to double check with the HSE on ACAS advice, they referred me back to ACAS as the regs do not specifically state how to deal wiht this & ACAS needed to interpret the rules.
