We have two guys coming up to 65 this year. One of them has submitted a written request to work for another year. The Factory Manager and the Operations Director do not want to create a precedent. They would like the lee way to be able to judge each case on its merits which would be nice but in the current climate their fear is that if we say no to one and then decide another person has skills we would like to retain and allow them to continue to work we would be opening a can worms.
Has anyone any experince of using short term contracts to manage this? Could we say that at 65 they retire but we can retain them on short term contracts – say three months and reviewed at the end of that time.
I know what the current legislation says but they are wary of creating grounds for tribunals
