I work in the UK office of a global company. I wish to transfer to a different department which is based in France.

My employer approves (in principle) the move to the new department but will not consent to my moving to the French office because I will then be subject to tighter restictions on working hours as France has no opt-out.

Is this legal? It seems to me that the company is using the WTR inappropriately: they are in effect saying that they want me in the Uk because I am more easily exploitable.

This rather defeats the idea of working for a global company and being a part of the EU. I am a better resource as a UK worker because they can make me work more hours. Not that I have ever worked to rule in any case….

Can anyone help clarify my legal position?
