We have an employee who has been signed off (mental illness) for several weeks. He is currently receiving SSP (and has claimed top up benefits from the government). We have received several reports that he has been out drinking & solicalising during this time and have now been (reliably) informed that he’s been working part time ‘cash in hand’ elsewhere. We would like him to resign (as redundancy is a nightmare). What is our position?
