Question:
"One of our sales representatives has been banned from driving for six months. Does this mean that we can dismiss him?"
HR tip:
Not automatically. First make sure that you have the facts, for example the date he should get his licence back and the reason for the ban. Was the reason something that could have a serious and adverse impact on the company and its standing? If so you could take disciplinary action.
Then consider whether the job could be done without use of a car, for example by travelling on public transport, a family member driving him, or by using the telephone and email. Or could you redeploy him somewhere else in the organisation for the period of the ban? Only if none of these is a reasonably practicable alternative could you move to dismissal.
