Company X is a UK/EU trading subsiduary of US parent company Y.
X is seeking a a HR Director. Candidates found in UK, 3 see CEO of X.
CEO wants to offer 1 person but is then told by company Y that they have a US internal applicant who should get the job.

Ethics aside, with the new migrant restrictions, can someone from outside the EEA/EU be offered a job that a UK Director could fulfil- or is this blurred by it being an internal promotion?

Thanks!
