We have an employee who has been off work sick for 28 weeks and has now submitted a GPs note for a further 13 weeks. He has exhausted his entitlement to SSp and company sick pay so is now on unpaid leave.
Our holiday entitlement is over and above that provided by the WTD. Does he continue to accrue contractual holiday entitlement or just WTD entitlement?
Would I be able to amend my contracts to say that once SSP and Company Sick pay entitlement have been exhausted all contractual entitlements other than stats cease – as for additional maternity leave?
