My partner was outsourced (along with the rest of his team) to a global IT company on a Tupe transfer 18 months ago. Under the transfer he has certain contractual rights protected, such as minimum redundancy pay out, benefits entitlement, etc. His role has now been outsourced to Bagalore and since the new year he & his colleagues have been paid to stay at home as their jobs no longer exist in the UK. The company say they will not make them redundant and will find them other jobs, however there is nothing available which even remotely matches their skill set and technical knowledge. They are becoming increasingly frustrated and want closure, as continuing to not work will be damaging to their skills development and career prospects. Can they demand to be made redundant? Any advice as to possible courses of action gratefully received.
