I was handed a letter detailing my bonus payment for the year 2003/04 on Monday 15th March 2004. I handed in my resignation on Tuesday 16th March, and the following day was told that my bonus would no longer be paid to me, in accordance with company policy. No such policy is contained within the Employee handbook and has not been communicated to staff in the past 3 years (duration of my full time employment with the company). HR have not been able to produce such a policy to date.
Is it legal for the company to withold the bonus, bearing in mind I had received a formal written letter detailing the payment, and bearing in mind it is paid in lieu of last year’s work.
