(I have my own strong views on this, but since this is a member of my family I am seeking some guidance from other practitioners before I speak to the person)

An employee with Diabetes has requested to work 8-hour shifts, due to her medical condition making it difficult for her to work 12-hour shifts. In response the employer put in place additional rest breaks for the employee. However the employee was still struggling doing the 12-hour shifts.

The employer asked her to consult an Occupational Health Doctor for a second opinion. The employee has the support of the OH Doctor who has written to the employer. Upon receiving the letter from the OH Dr. the line manager stated that they will have to consider a change in job title and pay rate due to the change in the number of hours being worked.

Is this fair?
