One of our employees was involved in an incident – outside working hourse, and was involved in a drunken fight with someone who unfortunately died as a result of injuries he sustained. There is no trial date been set as yet (have been advised that this could take up to a year), but we have currently suspended the employee, on full pay, but are considering coming to a compromise agreement with the employee. Has anyone else experienced a similar situation? Our MD wants to dismiss but we know that from an employment legislation perspective, this isn’t the best approach to take!
