My client has a full time permanent employed since April 2007. The contract says 1 weeks notice for the first 6 months and SSP only whilst sick. Employee has been off sick for 3 weeks, now signed off for a further two weeks. The medical issue is real and likely to require treatment and tests for some time after the employee returns to work. Problem is that client was preparing to give notice because he was not satisfied with performance before the illness – does he have to wait for return to work before giving notice and replacing with someone more suitable?
