An employee has asked whether we would support him if he was to join the TA.
My research shows that we could legally deselect a candidate based upon TA/reserve forces membership but to dismiss on those grounds would be illegal. This doesn’t answer my question.
In the absence of a policy – can I treat the request like a secondary employment request and accept subject to a trial period? The individual provides weekend cover in his current role and we have concerns about his ability to fulfil that part of his contract if he were on his 1 weekend per month TA duties or his 1 evening per week.
