I’m trying to interpret Employment Law regarding the entitlement to rest periods. Salaried staff, contracted 28.5 hours over 4 days, have traditionally been told that their 15 minute breaks morning and afternoon are NOT paid and are not included in their working hours. This is in addition to the one hour unpaid break at lunchtime. Full time staff contracted to perform the same duties, but over 5 days, are contracted 39 hours. They are paid for their breaks (not lunch)although the handbook states that ALL staff’s breaks will be unpaid. What is the legal position? The handbook does not appear to have been updated since Jan 01.
