One of our members of staff was employed by our organisation in a permament capacity on a fixed term basi. He had a two month notice period. At the end of the contract the employee was kept on but asked to act as a freelancer , so coming off payroll and billing on a monthly basis. Nothing has chnged for this employee other than he nows bills us on a monthly basis and he has now been with us 18 months. He asked me if they terminated his employment what his notice period would be and I said that as there had been no break in service it would still be two months.  Is that correct?
