An employee has been signed off sick for 2 weeks due to an accident (not work related).
However, he had previously booked 2 days holiday which now falls in the middle of this “sick period” and wants to cancel his holiday. Our Company Handbook states

“Incapacity During Holidays
Sickness payment will not be made in respect of days of paid holiday.”

The Manager has therefore refused the employee’s request and the employee is referring the matter to a Union official.

It’s my view that perhaps the employee could cancel the 2 days holiday but that he would lose sick pay.

Be pleased to receive others’ interpretation and any legal view on this.
Regards,
Elaine
