We are introducing a policy to discipline offenders of 3 sick periods in a year – so if someone is off twice the third time will lead to a discipline hearing.

However we are going to discipline those that had 3 or more periods off last year. We haven’t sent out amendments to this policy to any staff as yet so no one has signed anything to say they have received this change to the T&C’s.

Can we do this or are we leaving ourselves open to legal problems?
