We have an employee who is on long-term sick and is due to retire in 6 months time. The work that they were doing was very physical and it seems doubtful that they will be able to return to their job within the 6 months. They have a shoulder problem and there is no other job available at the moment that could be classed as light duties. The employee is still on the company sickpay scheme. Are we within our rights to dismiss based on capabilities? The employee’s Doctor is sitting on the fence with regards to the chances of the employee being able to return to work in the near future. Any comments would be appreciated.
