An employee is transferring under TUPE from the NHS to a contractor. The contractor is making this individual redundant based on the NHS redundancy policy. The individual is happy enough being made redundant, but it was said to him that the NHS policy states that if he finds any other work within the NHS while serving his notice, or up to 28 days after his notice finishes he will not get his redundancy. My view is that this is not the case, as he is no longer an employee of the NHS. It would only be the case if he found other work with the new contractor, in these timescales, that he would not be entitled to his redundancy. This individual has the possibility of a part time role with the NHS but is unsure of this information he has been given and does not want to jeopardise his redundancy payout. Any views would be helpful.
