There are 2 issues which I would like clarified:

1. If someone has less than one months service, do they still have to work the notice period in their contract?? In this particular case, it doesnt specify anything under one month – statutory notice periods seem to start with one month service to 2 years, so I am a little unclear.

2. What recourse does an organisation have if someone refuses to work their notice. This constitutes a breach in contract on the part of the employee and would mean that the employer wouldnt have to pay the whole period (which is understandable??) Can they actually DO anything else legally?
