We are about to close a factory site in Surrey and all staff will be made redundant – no problems here. My issue is that there are a number of staff at that site who work remotely or at other sites. Their contracts all state that site as their location, but I haven’t put them ‘at risk’ as their roles will not disappear.
They will not be required to base themselves at the new site (100 miles away) but is it possible (with their agreement) to change their contracts to home based? If they don’t accept this change, are they entitled to a redundancy payment?
Some have already suggested home working and are happy to do it, but would appreciate advise on the legal position.
